Translation VIII. Les observations de l'arbitre concernant l'obligation de minimiser le préjudice sont à rapprocher de celles contenues dans la sentence nº 5514, supra p. 1021. Si l'arbitre ne conteste pas l'existence de cette obligation, il constate que le vendeur ne l'a pas violée en tardant à rechercher un nouvel acquéreur. C'est que, comme dans l'affaire nº 5514 précitée, le créancier de l'obligation inexécutée pouvait légitimement espérer qu'une solution amiable serait trouvée avec le débiteur qui permît l'exécution du contrat. Il en allait d'autant plus ainsi dans la présente espèce où l'acheteur lui-même demandait des délais.

Translation VIII. The observations of the arbitrator concerning the obligation to minimize the prejudices are comparable with those which are contained in the sentence n°5514 p.1021. If the arbitrator does not contest the existence of this obligation, he confirms that the seller has not violated the obligation by failing to determine a new buyer. For this reason, like in the aforementioned affair n°5514, the creditor can lawfully trust that an amicable agreement can be found with the debtor which permits the performance of the contract. This is applicable all the more considering the present matter where the buyer has asked himself for an extension of time.
